Varick Planning Board

October 23, 2014

In attendance: Members Thomas Björkman, Herhey Sensenig, Linda Mastellar, David Kidd. Visitor, Jeff Hogue, chair of the Varick Zoning Board of Appeals.

Absent: Todd Horton and Barry Somerville. One vacancy.

Meeting called to order at 7:20 pm by acting chair Björkman in the absence of chair Horton.

Agenda:

Recommendations for revisions to code to resolve or prevent issues that reach the Zoning Board of Appeals.

Review revisions to code that incorporate all of our changes pertaining to Depot rezoning.

Revising Zoning Compliance Permit Application.

At the request of Code enforcement Officer Larry Colton, the Zoning Board of Appeals made several edits to the application that we developed and issued last year in order to make it easier for him to use. After some experience with the form, there were a few instructions and form fields that were not followed as easily as intended. These issues often end up with the ZBA, making that a good venue for making experience-based adjustments. One change is to require the third-agency approvals before issuing the permit so that the CEO can deny an application for something that is obviously against state law without having to try to enforce state law. One of the most common problems is that people think that they are exempt from getting a permit due to agricultural use when they don’t qualify. ZBA Chair Jeff Hogue presented the revisions and rationale for making them.

Mr. Hogue will provide an electronic copy to put on the town website.

Linda Mastellar moved to adopt the revised application, David Kidd seconded. Motion passed 4-0.

Mr. Hogue provided several examples of issues where the language in the Zoning Code is ambiguous or silent on issues that come before the ZBA. He asked the we revisit those sections to provide more clarity.

Nuisance. There is a nuisance provision (noise, lights, etc.) for the Lakeshore Residential and Hamlet Residential Districts, but not in the Agriculture and Rural Residential District. A similar provision would help resolve some neighbor complaints.

Bulk Table for accessory structures. The county also has a rule on this subject, and it would be helpful to be consistent. It is not helpful for the town to allow reduced setbacks that are then disallowed by the county building inspector.

"Side and rear setbacks for accessory structures under 140 sq ft and less than 15 ft high."

Have language that specifies which construction and land use requires a Town Zoning Compliance Permit. The most common actions for which people are failing to apply for permits are: putting barns on land that does not have an ag exemption, installing docks, and clearing land. Furthermore, Mr. Hogue’s understanding was that while construction of agricultural buildings on land that meets the agricultural exemption does not require a county building permit, compliance with town zoning codes is still required. Our codeis unclear on this point, and it would be helpful to resolve the issue.

The suggested revision.

102.2 “In order to ensure the purpose and intent of the requirements of the Zoning Code, the issuance of a permit is required for any construction, substantial improvements and certain other uses. (Some examples include new structures, additions, docks, fences, pools, andcertain uses.).”

We thought that wording was a good start, but “certain other uses” needed more definition. We also need to be clear about whether demolition requires a permit. While permits for demolition have a special zero fee, the word “demolition” is not in the code. The demolition permit provides a record that a specific use has ended, and also an opportunity to ensure that demolition debris is removed.

Definition of “structure.” Some things still fall in a gray area.

The current definition is “walled or roofed building” but we also use that term to mean antennas, docks and fences elsewhere in the code. We need to review all instances of “structure” in the code and expand the definition of structure so that use is included.

Nonconforming use clarification. (Section 501.) Our discussion led to a desire to make the language be more direct and create an incentive for owners to do the better thing rather than skirting the rules. A particular issue applies to rebuilding from the foundation up, which is not mentioned. Is it a major renovation where non-conforming setbacks can be retained, or new construction where the setbacks must be corrected? We want to encourage rebuilding deteriorated residences in the hamlets even if the foundation is non-conforming to current setbacks. The language also makes itdifficult. On the other hand, crowding between houses along the lakeshore is a significant problem, and one of the high-priority risks identified in the Comprehensive Plan.

The language is mainly about structures not other uses. Make sure that it is clear that once a non-conforming use ceases, it is not allowed to restart. Also that a non-conforming use is in compliance if the property is transferred to a new owner, as long as it remains continuous. Specify what constitutes “continuous use.” A new owner may need to close a business to the public for a time while renovating the facility, which is legitimate. On the other hand, uses may cease for a time for lack of interest or customers, and that should not be continuous use. Also, be clear that the definition of the use is fairly narrow. For instance, if the use was a “Vehicle Repair Shop” as defined in the code, then that specific use may continue but it cannot be converted to a different non-conforming use. There has been the incorrect notion that if there is any historic commercial use, then other commercial uses are permitted even if they are non-conforming to the current code. Those are new uses and must conform to the code.

Setback variance is one of the main things that ZBA does.

We asked Mr. Hogue to also send an electronic variance application form so that it could be on town website.

Mr. Hogue invited VPB members to attend ZBA meetings on the second Tuesday of odd months. 7:00 pm at the town hall to continue fostering a good working relationship between the two organizations.

Discussion of Depot language.

We confirmed that the map borders are correct.

We checked the Special Use Permit considerations, where there was new language. We added flexibility to the screening item so that it applied to more than just residential neighbors (e.g. scenic landscapes, a desirable character of some areas).

311.1 (D) Landscaping and Screening. All parking, storage, loading, and service areas shall be reasonably screened at all seasons of the year from the view of adjacent residential areas and the general landscaping of the site shall be in character with the surrounding areas. Screening may not be required if existing or proposed features of the site will mitigate any potential adverse effect on nearby properties.

Meeting opened at 7:05 – all members present.

Minutes for August meeting were reviewed and approved – motion made by Linda, second by Tom.

We reviewed map changes from last meeting to forward to Barbara. We are extending WITE area to cover the gate area on 96a. We also need her to work on developing language for cluster developments instead of PUD’s. Tom emailed her during our meeting and asked for a cost estimate so we can approach the board about this. We still intend to cover both of these items – depot zoning and cluster development in one public meeting.

Todd mentioned that we need to review all forms that are or will be online from the perspective of a consumer. Our only form now is the Zoning Compliance Permit but we may add special use, building permit, site plan review, etc.

Todd also emailed Larry Colton about attending our next meeting to touch base with him.

We met with Tim Wiant about possibly coming on the Planning Board to replace Bill Squires. We just reviewed how things work and the projects we are addressing.

Meeting opened at 7:05 pm. Members present were Hershey, Linda, Tom, Todd, and Barry.

Previous minutes were reviewed and approved, motion made by Linda, second by Todd.

Marc Romanowski came to the meeting to represent FLTG and readdress issues concerning the depot zoning. A letter was sent to the board addressing the following code revisions: 1) Allow warehouse, laboratory/R&D facilities and light manufacturing to remain allowed as of rights in the SBPI district; 2) Provide greater predictability in the code’s special use permit criteria, and 3) Remove the site plan requirement to obtain a zoning compliance permit.

The board thought these suggestions were good. Marc will contact Barbara Johnston about these  changes to the code.

Todd asked Marc a question about PUD’s as we are working on this aspect of the code. He suggested we stay away from overlay districts and suggested looking into cluster developments because they are mainly geared to residential areas. He is going to direct us to a source that may help us with inquiries. It may be that we can transfer our work on PUD’s and carry it over to this type of development.

We also reviewed an email that Todd received from Barbara J concerning the following: 1) a revised zoning map that reconfigures the AR district boundaries, 2) her agreement with the FLTG proposals, 3) Seneca White Deer comments about adding more Conservation land.

We thought the proposal of a Site Plan Review process would help a lot with the special use permit process. Tom and Linda are forwarding to us a proposal we will consider to send to Barbara so she can work this into our code.

Todd is going to contact Barbara about expanding the Conservation area south of SBPI district to the north end of the railroad line. We also want to extend the residential district on the east side north to Van Riper Rd.

Meeting opened at 7:08, members present were Todd, Linda, Dave, and Barry.

The minutes of the May and June meetings were read and approved, motion made by Linda and seconded by Dave.

Leslie Mauro, a lawyer representing Marc Romanowski from FL Tech Group was present to address concerns about the zoning proposal for the depot. FLTG seems interested in more specific language regarding telecommunications equipment, warehouse usage etc. These were addressed in a letter sent to the board that we have not had a chance to review. It seems that FLTG may want to continue doing what they are doing without the hassle of special use permits. We agreed to review and consider the items addressed in the letter but made no promises to change the code. We will make a decision how to proceed at the next meeting.

Dave brought up a discrepancy in the current code regarding schools. Sections 310.2 and 311.13 do not agree and need to be coordinated to read schools under 36 students. It is likely that we can revise this without a hearing, but we will ask Tom to make sure.

Todd brought up an issue concerning the AR zoning area on the west side of the depot. The railroad would like this designated WITE to promote industrial development near the entrance of the railway into the depot. Barbara Johnston also thinks a change should be made. Todd is going to call her, Bob Aronson, and Steve Absalom about these concerns. We need to make a decision about it in our next meeting.

We learned that Bill Squires has resigned from the board and we need a replacement. Barry will call Phil Knapp to see if he is interested in returning to the board.

PB minutes 5/22/14
Meeting called to order at 7:30 with Tom sitting in as chairperson. Members present were Linda, Dave, Tom and Barry.
Minutes from April 24 were approved, motion made by Linda, seconded by Dave. It was noted that the March minutes were emailed to Todd and not yet approved.
We discussed a few areas of the revised proposal for depot zoning that was forwarded to some of the members from Barbara Johnston. We specified that Green Energy such as wind, solar, and biomass(?) was included in the WITE area of the depot. We agreed that these should be listed in the code and add necessary requirements for wind mills.
Tom read a section listing restrictions for special uses in the depot from the above revised proposal. We agreed that these seemed appropriate and well written.
 We also decided that we should the Conservation area to Conservation and Recreation. Tom will notify Barbara of these changes.
Dave asked what the procedure was for final approval of the depot zoning. It is believed that we need to forward the proposal to the county planning board. There are also SEQRA requirements. We decided to let Todd find out the next step in the procedure. We will also forward a copy to the TB for their perusal and information. There will need to be a public hearing and final approval by the TB to adopt the new code.

PB Minutes 6/26/14

Meeting opened at 7:15 – members present were Todd, Hershey, Linda, and Barry.

The minutes from the May meeting could not be read as the secretary’s computer was down and the notes could not be retrieved. They will be reviewed at the July meeting.

Todd informed the board that the Seneca County Planning Board has resolved that zoning for the depot in the Town of Varick will be solely under local jurisdiction.

It was decided that the PB would compose a letter to the Varick TB about depot property returning to town ownership. A motion was made by Hershey, seconded by Barry and passed by all. Linda drafted a letter expressing our desire as a board that the Town Board begin proceedings to acquire depot lands and open County Road 135 in conjunction with zoning approval and town legal counsel.

No other business was conducted in regard to PUD’s. Our hope is to finish this language in the next session.

A motion was made to adjourn at 8:15 by Barry, seconded by Hershey. Next meeting is July 24.
